Terms of Service

1. The agreement

These terms are a contract between you and Tikyani Apps LLC ("Tikyani Apps", "we", "us"), a limited liability company registered in New Jersey, United States, at 971 US Highway 202N, Ste N, Branchburg, NJ 08876. They apply when you use our website or any of our apps. If you do not agree with them, do not use our products.

2. Your license to use our apps

We grant you a personal, non-exclusive, non-transferable license to install and use our apps for your own use, on devices you own or control. Apps downloaded from Apple's App Store are additionally governed by Apple's standard Licensed Application End User License Agreement (opens in a new tab) and the App Store terms.

Apple is not a party to these terms and has no obligation to provide support or maintenance for our apps. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

3. Accounts

Some of our apps require an account. Keep your credentials to yourself, give us accurate information, and tell us if you believe your account has been compromised. You are responsible for what happens under your account. You can delete your account at any time from inside the app (see the WheyGPT privacy policy (opens in a new tab) for the steps).

4. Subscriptions and billing

Paid features are sold as auto-renewing subscriptions billed by Apple to your Apple ID, and we never see your payment details. Prices are shown in the app before you pay. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period, in iOS Settings → your name → Subscriptions. Refunds are handled by Apple through reportaproblem.apple.com (opens in a new tab). If we change a price, the new price applies from your next renewal, and Apple notifies you in advance as its rules require.

5. Acceptable use

When using our products, you agree not to:

• break the law, or use the products to help anyone else break it;
• probe, overload, or disrupt our services, including circumventing rate limits or using our AI features as a general-purpose gateway;
• reverse-engineer, copy, resell, or scrape the apps or the services behind them, except where the law says we cannot stop you;
• access anyone else's account or data without permission; or
• misrepresent who you are to us or to other users.

We may suspend or terminate accounts that violate these rules.

6. Health disclaimer

Our apps, including WheyGPT, provide nutrition estimates and general fitness information. They do not provide medical advice, diagnosis, or treatment. AI-generated estimates can be wrong. Do not use our apps as a substitute for advice from a qualified clinician, and talk to one before changing your diet if you take medication (including GLP-1 medications), are pregnant, or have a medical condition.

7. Your content

You own the content you put into our apps: your photos, logs, and profile details. You give us the limited license we need to operate the features you use: for example, when you photograph a meal, we process that photo to return a nutrition estimate. We do not use your content to train AI models, and our privacy policy governs how content is handled.

8. Our property

The apps, this website, and our names, logos, and designs belong to Tikyani Apps LLC or our licensors. These terms do not give you any right to use them except as needed to use the products normally.

9. Third-party services

Our products rely on third-party services, such as Apple for distribution and billing, and the processors listed in our privacy policy. Those services are governed by their own terms, and we are not responsible for them.

10. Disclaimers

Our products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not promise that the products will be uninterrupted, error-free, or that estimates will be accurate.

11. Limitation of liability

To the fullest extent the law allows, Tikyani Apps LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the products is limited to the greater of fifty US dollars ($50) or the amount you paid us in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations, and nothing in these terms takes away rights you have as a consumer that cannot be waived. In those places, these sections apply only as far as the law permits.

12. Termination

You can stop using our products at any time, and you can delete your account from inside the app. We may suspend or terminate access if you breach these terms or if we discontinue a product; where reasonably possible we will give you notice first. Sections that by their nature should survive termination (including sections 8, 10, 11, and 13) survive.

13. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in New Jersey. If you are a consumer in a jurisdiction whose law grants you mandatory rights or a mandatory venue, those rights are not affected.

14. Changes to these terms

We may update these terms as our products evolve. Changes are posted here with a new effective date, and we will flag material changes in the app or by email. Using the products after a change takes effect means you accept the updated terms.
